Anglican Canon Law: Books

This volume brings together in one compass the Orthodox Churches - the ecumenical patriarchate of Constantinople and the Russian, Armenian, Ethiopian, Egyptian and Syrian Churches. It follows their fortunes from the late Middle Ages until modern times - exactly the period when their history has been most neglected. Inevitably, this emphasises differences in teachings and experience, but it also brings out common threads, most notably the resilience displayed in the face of alien and often hostile political regimes. The central theme is the survival against the odds of Orthodoxy in its many forms into the modern era. The last phase of Byzantium proves to have been surprisingly important in this survival. It provided Orthodoxy with the intellectual, artistic and spiritual reserves to meet later challenges. The continuing vitality of the Orthodox Churches is evident for example in the Sunday School Movement in Egypt and the Zoe brotherhood in Greece.

In a provocative essay, philosopher Jeffrie G. Murphy asks: 'what would law be like if we organized it around the value of Christian love, and if we thought about and criticized law in terms of that value?'. This book brings together leading scholars from a variety of disciplines to address that question. Scholars have given surprisingly little attention to assessing how the central Christian ethical category of love - agape - might impact the way we understand law. This book aims to fill that gap by investigating the relationship between agape and law in Scripture, theology, and jurisprudence, as well as applying these insights to contemporary debates in criminal law, tort law, elder law, immigration law, corporate law, intellectual property, and international relations. At a time when the discourse between Christian and other world views is more likely to be filled with hate than love, the implications of agape for law are crucial.

This book describes in detail the ways in which the life of the Church of England is affected by law. It deals with a great many topics including canonical jurisprudence, ecclesiastical government, the ministry of clergy and laity, faith, doctrine and liturgy, the churches' rites and themanagement of property and finance. Each of these subjects is studied and analysed critically and where appropriate comparisons are made with the Roman Catholic Church.Five general themes emerge:first is the degree to which the church can be said to be regulated; the second concerns the increasingly important use of administrative rules created executively at national and diocesian level to supplement the churches formal law; the third examines the relationshipbetween the formal law and the pastoral values of clarity, certainty and flexibility; the fourth theme is the applicability of secular law; the final theme is the comparison with the canon law of the Roman Catholic Church. Thus the book provides for the first time a comprehensive, descriptive andcritical analysis of the legal framework of the Church of England and the regulatory instruments which operate within this framework.

Drawing on unpublished records of these courts, Professor Helmholz describes the practical side of matrimonial jurisdiction and relates it to his outline of the formal law of marriage. He investigates the nature of the cases heard, the procedure used, the people involved and changes over the period covered, all of which add to what is known about marriage and legal practice in medieval England. The concluding assessment of canonical jurisdiction over marriage suggests that the application of the law was more successful than is usually thought.
